Politics Unusual Politicians are the threads within a community. If you are represented well your city, county, state and federal issues will be heard and a seamless society evolves. Sadly, the majority of people do not vote, many voices are therefore unheard and often representation lacks the wisdom it deserves. As far as our profession goes, it is your state legislators that enact bills and laws that govern how we practice and too often scope laws will stifle professional growth and income. This is so true is the State of Georgia, where I practice. The Georgia Chiropractic Practice law was written in 1921. Regardless how a Georgia DC practices, innovations and techniques have evolved greatly since 1921. Granted, along the way we were able to implant a number of clarifications within the scope, but insurance providers looking for ways to avoid legitimate payment of services rendered have amble opportunity to send an EOB back stating services denied because it isnšt within our scope of our practice. Whether you like politics or not, it is the nature of this beast that we work together to preserve the crumbs we have and protect our future. A Georgia court ruling in 2004 has had a dramatic impact on reimbursement for chiropractic and highlights our need for change. This ruling, states that only procedures specifically listed in the chiropractic scope of practice statute are permitted. The court clearly stated that when chiropractors refer for procedures outside of their scope, the procedures must be performed under the authority of any medical provider competent to order the procedures. The way the hungry medical association lobbyists see it, they should be gatekeepers for all musculoskeletal conditions and that chiropractic care should be by medical referral only. Although this has not transpired, it is not too far fetched to see that one win against us may be used to catapult another. The Georgia scope law, originally passed in 1921, only provides for adjustment of the articulations of the human body and the use of electric x-ray photography, nothing else. No examinations, rehabilitative procedures, requesting MRIs or other diagnostic test that are readily used today. State Farm insurance refuses to pay for rehabilitative services stating it is not within our scope of practice. Is this just the beginning? Patients should have equal access to their chiropractor for exercise training, advice on diet and nutrition, and rehabilitative services on an equal footing with any other licensed providers. They should have the assurance that their chiropractor can order the appropriate diagnostic testing when their problem looks to be beyond the scope of chiropractic care. Besides doctors, our vendors will most certainly be impacted. Insurers have already begun denying services they had previously been paying. Range of motion testing, therapeutic exercises, orthotics, neuromuscular re-education and any other services they interpret to be outside our scope are no longer being reimbursed or are being reconsidered. The answer to this is a solid scope bill that requires the cooperation of state politicians and persuading them to see our and our patients point of view. And this requires a lobbyist and the trappings that come along with it .. money and lots of leg work. Consider this, if organized medicine succeeds in taking away our right to direct access to patients, it would only be a matter of time before they begin looking at other states. The profession cannot afford to stand idly by and watch this happen. This has become a Georgia crisis and has banded together the Georgia Chiropractic Association, the Georgia Council of Chiropractic, Life University and the Board of Examiners. They all have a like mind to create an equitable scope law and have it pass through the State House and Senate. This takes Political Action Committees and association members willing to meet their representatives and persuade them to either initiate the legislation or approve it when it passes their desk. I first encourage everyone reading this e-mail to join their state association and be a part of the solution by being active in protecting this honored profession. Second, I encourage everyone to financial participate in funding these political action committees. Each month, I give money to the GCA political action committee and encourage that you do as well, whether it be in Georgia or your own state. Koren "defamation" case, ruled that Stephen Barrett wasted the Lehigh County Court's time with his meritless claims. Just before lunch on Thursday, October 13th, 2005 (today), Judge Johnson of the Lehigh County Court of Common Pleas turned to the jury assembled to decide a case brought by one Stephen Barrett, a local resident, against famous Chiropractor, author, publisher, and health advocate Tedd Koren DC - and told the jury that he was ruling in favor of a Motion made by Defendant Koren. The Judge's ruling in favor of Koren's Motion, officially called a "Motion for Directed Verdict," approved Koren's request that "the Court enter judgment in its favor before submitting the case to the jury because there is no legally sufficient evidentiary foundation on which a reasonable jury could find for the other party." Under Federal Rules of Court this type of motion is known as a "Motion for judgment as a matter of law."
