Q: Hey doc, I have a friend who has been asked to sign a contract with a non- compete clause in it. he said the non-compete is one year, 4 miles with a $200, 000 in damages if broken. Is this about right? He's not sure whether or not to sign. A: Thanks for the e-mail. There is right or wrong answer to non compete clauses. Some states consider it not even legal .. but it is a matter of courtesy as I see it. 4 miles and one year is not too much but the $200,000 is very extreme. I would recommend the DC to discuss the matter with the other doc and work something out .. or just go for it and not worry about it.
