Q: Our state has just switched to a tort system from a no fault system. What will happen A: About 15 years ago Georgia switched from a no fault state to a sue as you go state. During no fault everyone had coverge for care but since the demise of no fault people now have the option to add "Medpay" to their personal auto policy. Medpay is a portion of your personal auto insurance that will pay the doctor directly rather than relying on the offending auto insurance or an attorney. Saving money caused people who have health insurance to stop adding the Medpay portion to their auto insurance and rely on health insurance (managed care limited pay) or the third party or attorney for settlement which is always a risk. What eventually happened was less insurance settlements .. attorneys not accepted low impact cases due to limited payments .. attorneys giving only a portion of the settlement and patients walking away with no pay since the third party insurance pays them and you hope they pay you. It took awhile for it to be as pitiful but there are some honest attorneys and patients out there as well as some wise people that add their Medpay coverage to their policy. Good Luck
