Q: Hello Doc, I am in need of some practice management advice. We have talked about this in the past. it is about an IC that I have brought into my office. He has signed a contract that has him paying me 500 a month base rent plus 30% collections. Well I have two problems..... one he is now late for may rent and June rent. for every day that he is late he pays a 1% per day of base rent additional charge. This is leaving him with late fees of 385$ on top of what he owes for rent. my second problem is that he is only coming in to work on mon, wed, fri and then it is from 11-5. not much of a week for a person with a new practice. There is no leg work being done for new patients and he is taking about running ads for new patients. Seems weird. I am developing a dislike for him because I do not feel he is trying. How would you handle this? A: Thanks for the e-mail and question. If it was me .. I would notify him in writing that he has to pay all back and present rent by July 15 plus penalties to remain within your office. Even if he has to borrow the money he has to show good faith to keep up with the basic rental fee .. this is the same as a person renting your house. Depending on the teeth within your contract .. if he cannot make this payment I would sever his relationship with the understanding that he will be sent to a collection service or small claims court if he continues to be in debt to you. This may sound cruel and not supportive of a fellow DC .. but as you wrote .. it has become negative and soon will be a burden to you when suspicion shows up .. like what he is doing when you are not there .. it really gets hairy. If you do kick this IC out .. be sure to gather all the office keys and don't leave the office until you change the locks. Sorry .. but you need to nip this in the bud .. rent has to be paid and his not keeping his part of the bargain.
