ICA'S RELATIONSHIP WITH ARNOLD SCHWARZENEGGER CONTINUES TO GROW AND STRENGTHEN WITH ICA'S COUNCIL ON FITNESS AND SPORTS HEALTH SCIENCE PARTNERING WITH ARNOLD TO SUPPORT THE INNER CITY GAMES, a nationwide community action program developed by Arnold to organize after school activities for young people. This year ICA honored Arnold Schwarzenegger's commitment to chiropractic and health by presenting a donation of $10,000 to the Inner City Games. The mission of the Inner City Games is to provide opportunities for inner-city youth to participate in sports, educational, cultural and community enrichment programs and to help America's young people build confidence and self-esteem. ICA's Council on Fitness is also working to help support and promote the national Inner City Games Competition to be held in July. PHYSICAL THERAPISTS IN PENNSYLVANIA NOW HAVE DIRECT ACCESS TO CONSUMERS after Governor Mark Schweiker signed legislation on February 21st, 2002 making Pennsylvania the 35th state to offer PT services without referral to all members of the public. This victory for PTs caps off a massive year-long campaign in which the Pennsylvania physical therapists and the 64,000 member American Physical Therapy Association focused their efforts in the Keystone State to pass this breakthrough bill. This new bill allows PTs to practice physical therapy without referral for up to 30 days after the first treatment, expands the State Board of Physical Therapy and, for the first time, requires professional liability insurance for PTs in Pennsylvania. It is ICA's understanding that this bill, though providing direct access, does not in any way allow PTs to render chiropractic spinal adjustments. ICA holds that any professional who aspires to this authority must have a doctor level education equivalent to that of a DC. THIS EFFORT IS PART OF A NATIONWIDE CAMPAIGN BY PHYSICAL THERAPISTS TO MASSIVELY ENHANCE PT STATUS THROUGH LEGISLATION. ICA IS THE ONLY NATIONAL ORGANIZATION FIGHTING THIS WAVE AND WE INVITE ANY STATE ASSOCIATION BATTLING PTs IN THEIR LEGISLATURE TO CONTACT ICA FOR HELP. Eleven different medical societies sought court intervention on these fee-related issues (American Society of Cataract and Refractive Surgery v. Thompson, No. 00-2518), but the 7th U.S. Circuit Court of Appeals upheld a district court's dismissal of the case for lack of jurisdiction. Every section of the Medicare statute contains a passage that says that providers cannot sue the federal government over reimbursement issues. This decisive federal court action highlights the difficulties in seeking to change federal administrative policies in Medicare through the courts. ICA's Chief Legislative Strategist former Congressman Randy Tate said, "This court action simply reinforces the need to seek Congressional changes in the program as the best way of guaranteeing that Medicare will do what chiropractic wants. Medicare has no boss but Congress and passing ICA's Medicare reform bill, H.R. 2284 is what the chiropractic profession must do to guarantee its status in this massive federal program." THE LEGISLATION GOVERNING THE PRACTICE OF CHIROPRACTIC IN MANITOBA, CANADA IS ABOUT TO BE OPENED UP FOR REVISION and the Manitoba Chiropractors' Association (MCA) is circulating possible amendments and additions to the law. Among the possible changes would be the establishment of greater discretion on the part of the Manitoba Association in the regulation-making process and would, for example, if enacted permit the Association to mandate continuing education and professional liability insurance. The MCA is also seeking provisions that would allow doctors of chiropractic the right to incorporate, an important step in securing a sound business foundation for larger practices. The Board of the MCA serves as a regulatory and standards body for the Province and has considerable official power. Final say about proposed changes is in the hands of the Legislative Assembly of Manitoba.
